In order to start a divorce in Texas, you must have been a resident for at least 6 months before filing for divorce.
To begin the process, you will file a Petition for Divorce with the District Court. A judge will typically wait 60 days before making a final divorce decree.
The Process:
Petition for Divorce – The Petitioner will be the one that initially files for divorce in the county where either spouse lives.
Notice & Answer – Respondent will have to file an answer by 10:00 a.m. on the Monday following the expiration of 20 days.
Appeal – There’s a 30-day period after the judge issues the final divorce decree where either spouse can file an appeal if necessary.
